The short version

  • RainbowSay is a study tool. Use it for personal and educational purposes, and don’t misuse it or try to get around its limits.
  • You are responsible for the audio you use it with. Respect copyright and the terms of the services you watch, and get consent before captioning or saving other people’s voices in calls, meetings or classrooms.
  • AI makes mistakes. Translations, vocabulary and grammar explanations can be wrong. Don’t rely on them for legal, medical or safety-critical decisions.
  • Paid plans renew until you cancel, and you can cancel any time from the app. Upgrades apply immediately; downgrades apply at the end of the period you’ve paid for.
  • Credit isn’t cash. Add-on credit never expires; free and promotional credit has no cash value.
  • Fraud or abuse can get an account disabled.
  • If your use of the Service leads to a claim against us, you cover it. For example, a claim that audio you captured infringed someone’s rights or was recorded without consent.

This summary is here to help. The full text below is what applies.

Agreeing to these terms

These Terms of Service (“Terms”) are an agreement between you and RainbowSay (“we”, “us”). They cover the RainbowSay desktop app, this website and the cloud service behind them (together, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

If you use the Service on behalf of a school, company or other organization, you confirm that you are allowed to accept these Terms for it.

The service and your account

RainbowSay listens to audio on your computer that you choose to capture — what it is playing, or your microphone — and uses AI to transcribe, translate and explain it, as sentence-by-sentence study cards or as live subtitles.

  • Account. You sign in with a Google account. Keep it secure; you are responsible for what happens under your account. One person per account.
  • Age. You must be at least 13 years old. If you are under the age at which you can enter into a contract where you live, you may use the Service only with the permission and involvement of a parent, guardian or teacher, who accepts these Terms for you.
  • Devices. You can use your account on several of your own computers, up to a limit. When you go over it, the oldest devices are signed out.
  • Changes and availability. We are continually improving the Service and may add, change or remove features, languages and limits. We try to keep the Service available but don’t promise that it always will be. The Service depends on third-party AI providers, and it needs an internet connection.

Plans, billing and cancellation

  • Free plan. New accounts receive a one-time starter credit. No payment method is needed. We decide the amount, may change it for future accounts, and grant it once per person.
  • Paid plans. Paid plans are subscriptions, billed in advance each month or each year through our payment processor, Stripe. Each plan comes with a monthly usage allowance that can be spent on any feature. The allowance resets each month — on yearly plans too — and unused allowance doesn’t carry over. The “up to” figures on our pricing page are estimates of what an allowance covers, not guarantees; actual usage depends on how you use the Service.
  • Renewal. Your subscription renews automatically at the end of each billing period, at the then-current price, until you cancel. If we change the price of your plan we will tell you in advance, and the new price applies from your next billing period.
  • Cancelling. You can cancel at any time from the app, which opens Stripe’s billing portal. Your plan stays active until the end of the period you have paid for, and then your account moves to the Free plan.
  • Switching plans. An upgrade takes effect immediately: you are charged the price difference and receive the new plan’s allowance right away. A downgrade takes effect at the end of the period you have already paid for.
  • When the allowance runs out. New sessions won’t start, and a running session is wound down, until your allowance resets, you add credit, or you change plan. We never charge overage fees.
  • Failed payments. If a payment fails we may retry it; if it still can’t be collected, your subscription may be cancelled and your account moved to the Free plan.
  • Refunds. Except where the law requires otherwise, payments are non-refundable. If something went wrong, write to support@rainbowsay.ai and we will look at it with you. If a subscription payment is refunded, the plan ends when the refund is made.
  • Taxes. Prices may not include taxes; where they apply, they are added at checkout.

Add-on, free and promotional credit

  • Add-on credit. On a paid plan you can buy add-on credit in the app. It is used automatically once your monthly allowance is spent, and it does not expire while your account remains open and in good standing.
  • Free and promotional credit. Starter credit, referral credit and any credit we give you — for example to students, teachers or creators — is a courtesy. We may set conditions on it, and we may withdraw credit that was obtained through error, fraud or abuse, such as creating multiple accounts to collect it.
  • Referrals. If you invite someone and they create a new account through your link or invitation, we add referral credit to your account when they make their first paid purchase, up to the number of referrals we currently allow. The person you invite receives the usual starter credit. If their purchase is refunded, charged back or found to be fraudulent, the referral credit is removed. We may change or end the referral programme at any time.
  • Credit isn’t money. All credit can be used only for usage of the Service. It has no cash value, can’t be transferred, sold or exchanged, and — except where the law requires otherwise — purchased credit is non-refundable. If a credit purchase is refunded or charged back, the credit is removed, which can leave a negative balance to be covered before further usage.

Acceptable use

RainbowSay is for personal study, teaching and research. You agree to the following.

The audio you capture is your responsibility

RainbowSay can listen to anything your computer plays or your microphone hears. We don’t choose, see or control that audio — you do. So:

  • Have the right to use it. Only capture and process audio that you are entitled to use this way. Respect copyright, and the terms of the streaming services, platforms and publishers whose content you play. Those terms are between you and them.
  • Keep it personal and educational. Transcripts, translations, subtitle files and audio clips saved on your computer are for your own study, teaching and research. Don’t redistribute, publish or sell other people’s content, or translations and subtitles of it, without permission from whoever owns it.
  • Get consent before capturing other people. If you use RainbowSay on a call, in a meeting, a classroom or any conversation, other people’s voices are sent to an AI provider for processing and may be saved on your computer. Tell them, and get any consent the law requires where you and they are — many places require the consent of everyone in the conversation. Teachers: follow your school’s policies before using it with pupils.
  • Don’t use it for surveillance, covert recording, or capturing anyone’s confidential or sensitive information without authorization.

General rules

You also agree not to:

  • break the law, or infringe or violate anyone else’s rights;
  • get around usage limits, plan limits or billing, or create multiple accounts to collect free credit;
  • resell the Service, share your account, or provide it to others as a service of your own;
  • reverse engineer, scrape, overload or interfere with the Service, or use its credentials or servers with anything other than the official app;
  • use the Service to generate content that is unlawful, harmful or abusive, or in a way that breaks the usage policies of the AI provider the Service relies on;
  • use the Service to build a competing product, or to train AI models on its output.

AI output

The Service uses artificial intelligence to produce transcripts, translations, vocabulary and grammar explanations, spoken audio and chat answers. AI output can be inaccurate, incomplete, out of context, or simply wrong, and it may differ each time. It is a study aid, not a professional translation or interpretation.

Do not rely on it where a mistake could cause harm — including legal, medical, financial, immigration, emergency or other safety-critical situations, or as the official record of what someone said. You are responsible for how you use the output.

Third-party services

The Service works with services run by others, including OpenAI (AI processing), Stripe (payments) and Google (sign-in). Your use of them may be subject to their own terms and privacy policies, and we are not responsible for services we don’t control. The apps, websites and media you use RainbowSay alongside are not part of the Service, and nothing in these Terms gives you rights in their content. RainbowSay is not affiliated with or endorsed by any streaming service, platform or publisher.

Intellectual property

  • Ours. The Service — the app, the website, their design, text and code, and the RainbowSay name and logo — belongs to RainbowSay and its licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app under these Terms.
  • Yours. We claim no ownership of the audio you process or of the output generated for you. As between you and us, it is yours, subject to the rights of whoever owns the underlying content. Your study history stays on your computer.
  • Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.

Suspension and termination

You can stop using the Service at any time, and you can ask us to delete your account by writing to support@rainbowsay.ai.

We may suspend or close your account, or limit your use of the Service, if you break these Terms, if we need to do so to comply with the law, or to protect the Service or other people. In particular, if our payment processor blocks a payment as fraudulent or warns us of fraud, the account may be disabled automatically; write to us if you think that was a mistake. Where it is reasonable to do so, we will tell you before or when we act.

When an account is closed, your right to use the Service ends. Sections of these Terms that by their nature should continue — such as those on credit, intellectual property, disclaimers, liability, indemnity and governing law — continue to apply.

Disclaimers

To the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t warrant that the Service will be uninterrupted, secure or error-free, that AI output will be accurate, or that using the Service will lead to any particular learning result.

Limitation of liability

To the fullest extent the law allows, RainbowSay and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to the Service or these Terms. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim arose, or fifty US dollars.

Nothing in these Terms limits liability that cannot be limited by law, or takes away consumer rights that you have under the law of the country where you live.

Indemnity

RainbowSay processes whatever audio you choose to give it, and we have no way to check that you were entitled to do so. If that choice leads to a claim against us, you cover it.

To the fullest extent the law allows, you agree to defend, indemnify and hold harmless RainbowSay and its officers, directors, employees, contractors and suppliers from any claim, demand, loss, liability, damages, cost or expense — including reasonable legal fees — brought by a third party that arises from or relates to:

  • your use of the Service;
  • the audio you capture, process or save with it, and what you do with the output — for example a claim that audio you captured infringed someone’s copyright, or was recorded without the consent of the people in it;
  • your breach of these Terms; or
  • your violation of any law or of anyone’s rights.

We may take over the defence and settlement of any such claim at our own expense, in which case you will give us the cooperation we reasonably ask for. You may not settle a claim in a way that admits fault on our behalf or places obligations on us without our written consent.

If you are a consumer, this section applies only to the extent the law of the country where you live allows.

Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings there.

Before starting any formal proceedings, please write to support@rainbowsay.ai. Most problems can be sorted out by talking to us.

Changes to these terms

We may update these Terms as the Service changes. When we do, we will update the effective date at the top of this page. If you keep using the Service after a change takes effect, you accept the new Terms; if you don’t agree, you can cancel and stop using the Service.

General

If a part of these Terms turns out to be unenforceable, the rest stays in effect. If we don’t enforce a term, that isn’t a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganization, merger or sale of the business. These Terms, with the Privacy Policy, are the whole agreement between you and us about the Service.
